Subject:

Texas A&M University System, Texas Engineering Experiment Station, Nuclear Science Center Reactor (NSCR, License No. R-83, Docket 50-128) - Request to Extend Deadline for Submittal of RAI responses.

Dear Mr. Hardesty,

On June 24, 2010 the Texas A&M University System, Texas Engineering Experiment Station (TEES), Nuclear Science Center (NSC, License No. R-83) received a letter from the NRC titled "Request for Additional Information Regarding the Nuclear Science Center Reactor License Renewal". Attached to the letter were 37 individual RAI's.

In addition to those RAI's, the NSC owes the NRC responses to Questions 3 and 4 of financial RAI's submitted November 13, 2009. Regrettably, the NSC will not be able to meet the deadline and requests an extension. An extension to August 31 is requested.

The NSC has made progress on its responses. Questions 1 and 2 of the financial RAI's were completed but as of yet we have been unsuccessful in the electronic submittal process. Of the 37 individual RAIs received in June, the following are under final review: 4, 5, 6, 7, 8, 9, 10, 12, 15, 16, 18, 21, 22, 23, 24, 28, 29, 30, 31 and 35.

There has been a number of extenuating circumstances causing this delay in response. Primary reasons for the delay are the following: a 2-week maintenance outage, 5 man weeks of vacation taken by the staff, and extension of work on an experiment with General Atomics towards the production of Moly-99.

If you have any questions, please contact me at 979-845-7551.

I declare under penalty of perjury that the foregoing is true and correct. Executed on July 23, 2010.
