Dear Commissioners:

On July 14, 2010, on behalf of Southern Alliance for Clean Energy (SACE), I filed a Petition for Interlocutory Review of LBP-10-12 (Denying SACEs Waiver Petition) (Petition for Interlocutory Review). In footnote 2 at page 5, the Petition for Interlocutory Review stated that SACE was currently preparing a request for construction of Watts Bar Unit 2 pending resolution of the issues raised by the petition.

The purpose of this letter is to inform you that at this time, SACE does not intend to file a petition to suspend construction of Watts Bar Unit 2. However, SACE continues to seek interlocutory review by the Commission of the Atomic Safety and Licensing Boards decision to reject SACEs request for a waiver of NRC regulations exempting operating license applicants from need for power and alternative energy analyses under the National Environmental Policy Act. Because ongoing construction activities at Watts Bar Unit 2 have the potential to moot the significant environmental issues raised in the Petition for Interlocutory Review and foreclose the consideration of meaningful alternatives (see discussion in Section III.B), SACE requests the Commission to give expedited consideration to its petition.
