Dear Mr. Gatlin:

Enclosed for your information is the synopsis of the Nuclear Regulatory Commission (NRC)

Office of Investigations= (OI) completed report regarding potential violation of Fitness for Duty Procedures.

OI determined there was insufficient evidence to substantiate the allegation that an SCE&G/Summer maintenance employee willfully violated the licensees FFD program. We plan no further action with regard to this matter. Should you have any questions concerning this letter, please contact us.

In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter and its enclosure will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS). SYNOPSIS This investigation was initiated on October 29, 2010, by the U.S. Nuclear Regulatory Commission (NRC), Office of Investigations (OI), Region II (RII), to determine whether a maintenance worker employed by South Carolina Electric & Gas, Inc (SCE&G), at the Virgil C. Summer Nuclear Station (Summer) willfully violated the licensee fitness-for-Duty (FFD) Program. This investigation also supplementally addressed an issue regarding an unnamed manager coaching or aiding employees in a work related exam.

Based on the documentation and testimony developed during this investigation, OI:RII did not substantiate the allegation that an SCE&G/Summer maintenance employee willfully violated the licensee FFD program.
