Dear Mr. Heacock:

The Region I Field Office, NRC Office of Investigations (01), initiated an investigation (Case No.

1-2009-034) on June 4,2009, to determine whether a Millstone Health Physics (HP) supervisor directed an HP technician not to write a condition report (CR) in an attempt to cover-up the identification of a contaminated cam lock cap in August 2008. Based on evidence developed during the 01 investigation, the NRC was unable to substantiate that the HP supervisor deliberately directed an HP technician not to write the CR as part of a cover-up.

Following an INPO evaluation that identified that Millstone had issues with the control of radioactive tools, a team was created to perform a comprehensive sweep survey of the facility.

From May 19 through August 29, 2008, over 1 million items were surveyed. As a result, about 350 items were identified that were above radiation survey limits, including the contaminated cam lock cap. An HP technician, who was told of the matter, informed an HP supervisor of his/her plans to write a CR. The supervisor told the technician that the contaminated cam lock cap would be captured in a global CR covering the survey findings when the survey was complete. 01 noted that there were several managers and supervisors who were aware that there was a plan to document the contaminated cam lock cap issue in a global CR. The HP technician testified that he/she did not write a CR specific to the discovery of the contaminated cam lock cap because the supervisor discouraged her from doing so. However, the technician was never specifically told by the supervisor, or any other supervisor, that he/she could not write aCR.

Following completion of the survey, the team leader sent a summary of the team's results to the supervisor and other HP staff in an electronic mail message dated September 3, 2008.

However, 01 concluded that the global CR was not written at this time due to poor communication amongst various HP personnel, and not due to an attempt to cover-up the contaminated cam lock cap issue. Specifically, the survey was a well known event throughout Millstone and the results were well documented. The supervisor had various communications between first line supervisors and experienced HPs regarding this matter, which supports that the supervisor was not attempting to cover-up the discovery of the contaminated cam lock cap.

After it was identified that a corrective action related to the survey was inadvertently closed stating that a CR (the global CR) had been written when it had not, the supervisor wrote the global CR on February 6, 2009, entitled, "Survey Results from 2008 Millstone Station Tool Assessment."
