UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION ATOMIC SAFETY AND LICENSING BOARD Before Administrative Judges:

Lawrence G. McDade, Chairman Dr. Kaye D. Lathrop Dr. Richard E. Wardwell In the Matter of ENTERGY NUCLEAR OPERATIONS, INC.

(Indian Point Nuclear Generating Units 2 and 3)

Docket Nos. 50-0247-LR and 50-286-LR ASLBP No. 07-858-03-LR-BD01 May 26, 2010 Order (Granting Parties Joint Motion for Correction of Transcript)

The NRC Staff filed a joint motion on behalf of Entergy Nuclear Operations, Inc., the State of New York, the State of Connecticut, Riverkeeper, Inc., Hudson River Sloop Clearwater, Inc., and the Town of Cortlandt, seeking correction of the transcript from our April 19, 2010 telephonic status conference.1 The Motion is granted and the approved corrections are attached to this Order.

However, we question the need for such corrections in the future. Unlike an evidentiary hearing, or even oral argument in which significant concessions may be made by counsel that would later be cited by the Board in reaching its decision, the transcript of a status conference is prepared only for the convenience of the parties.

1 Joint Motion for Correction of Transcript of April 19, 2010 Prehearing Telephone Conference (May 21, 2010); see also Joint Response of the State of New York, the State of Connecticut, Riverkeeper, and Hudson River Sloop Clearwater to NRC Staffs Motion for Leave to Propose Transcript Corrections and for the Scheduling of a Prehearing Telephone Conference (May 24, 2010).

We would expect that only material errors in transcripts, which could lead to errors by the Board or would confuse the record, would justify the time of the parties to correct the transcript.

It is so ORDERED.
