We respectfully ask clarification and reconsideration of your email. Pilgrim Watch understands that 10 CFR 3.213(b)(2) says that a party may move that a Licensing Board member disqualify himself, and that normal practice is that a motion is directed to such Licensing Board member. However, Pilgrim Watch also understands that 10 CFR 232(c) explicitly states that whether a party may file a reply to a response is to be decided by "the Secretary, Assistant Secretary, or the presiding officer." Pilgrim Watch sees no inconsistency between directing the motion to disqualify itself to the particular Licensing Board member, and having the presiding officer decide whether a reply to a response is permitted. Judge Abramson will decide whether to recuse himself based on all of the papers, but having him also decide whether a reply can be filed would itself raise additional issues.

Although 10 C.F.R. 2.323 concerns motions generally, under 2.313(b)(2) as I read it, any motions for recusal, and by implication any related filings, are to be directed to the board member it concerns. Therefore, would all parties please direct any and all remaining such filings to Judge Abramson.
