Dear Mr. Collins:

The purpose of this letter is to inform you that no further action will be taken on your April 21, 2010, request to prevent the restart of Millstone Power Station, Unit NO.3 (MPS3),

since on May 20,2010, you withdrew your request for action. Your original request was made to prevent the restart of MPS3 in a paper regarding Millstone Power Station (Millstone), which was received by the NRC on April 21,2010. Additional revisions to your paper were submitted to the NRC on April 22, April 29, and May 6, 2010. The NRC contacted you on May 3, 2010, to confirm review of your request under Title 10 of the Code of Federal Regulations (10 CFR),

Section 2.206, "Request for Action under this subpart." You confirmed your intention of NRC review under this Section. A public version of all four revisions of your paper can be found at Agencywide Documents Access and Management System (ADAMS) Accession No.

You requested that the NRC not allow MPS3, operated by Dominion Nuclear Connecticut, Inc.

(DNC or the licensee), to restart after its scheduled refueling outage until the staffing safety issue (associated with the recent reduction in staff at Millstone), and other safety issues identified in your paper, are fully investigated and addressed to the satisfaction of: (1) NRC resident inspectors; (2) Institute of Nuclear Power Operations (INPO) representatives; (3)

Millstone Oversight department; (4) Millstone managers; (5) Millstone workers; and (6) the Connecticut Attorney General's office. In the April 21 and April 22, 2010, revisions of your paper, you requested the Governor of Connecticut to prevent the restart of MPS3. You subsequently revised your request in the April 29 and May 6, 2010, revisions, to request the Nuclear Energy Advisory Group' to recommend that the Connecticut Governor prevent restart.

However, the authority to prevent the restart of MPS3 lies with the NRC. Hereafter, your request is referred to as "the petition."

The petition was assigned to the NRC's Office of Nuclear Reactor Regulation (NRR). NRR's Petition Review Board (PRB) met on May 3, 2010, and made an initial determination that no immediate action should be taken. The PRB made this determination based on the absence of an immediate safety concern. On May 10, 2010, you were advised of the PRB's decision and were provided the opportunity to address the PRB. You requested to address the PRB and a teleconference was scheduled for May 20, 2010.

Therefore, the NRC staff cancelled the May 20,2010, teleconference. TAC Nos. ME3878 and ME3879, which were used to track this work, will be closed.
