Dear Mr. Lawyer:

Thank you for your letter of 7 April 2010 initiating consultation on behalf of the Nuclear Regulatory Commission (NRC) for the above referenced undertaking in order to comply with Section 106 of the National Historic Preservation Act of 1966 and its implementing regulation at 36 CFR Part 800. You are requesting that I review the undertaking and concur with your finding of "No Historic Properties Affected."

As I presently understand it, the NRC is considering issuance of a renewed Facility Operating License No. R-116 (the undertaking) to be held by the University of California Irvine which would authorize continued operation of the UCI reactor which is a 250 KW research reactor located in the Rowland Building on the UCI.

Although not explicitly stated, I am assuming the APE for the undertaking is the footprint of Rowland Hall which I find satisfactory pursuant to 36 CFR 800.4(a)(1). Rowland Hall was constructed in 1967 and the original reactor license issued in 1969 and neither the building nor the reactor appears to be of exceptional significance to warrant inclusion in the National Register of Historic Places (NRHP). Therefore, the NRC has determined the undertaking will not have an effect on historic properties. I concur with this determination.
