ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation associated with a White Significance Determination Process finding will be issued on or about May 12, 2010, to Southern Nuclear Operating Company, Inc. (Licensee), as a result of inspections at the Edwin I. Hatch Nuclear Plant. This finding, an issue with low to moderate safety significance, which will require additional NRC inspections, was determined to have a cross-cutting aspect in the Operating Experience component of the Problem Identification and Resolution Area (P.2.(b)). Between 1988 and 2009, the Licensee failed to establish and perform preventative maintenance activities on components having a specific lifetime. This led to a surveillance failure which declared the 2A Emergency Diesel Generator (EDG) inoperable.
In lieu of a Regulatory Conference, the Licensee submitted a written response that addressed additional plant specific factors. The response did not dispute the apparent violation or the cross-cutting issue but stated that the Licensee did not agree with the color of the finding. After reviewing the information developed during the inspection and the additional information provided by the licensee, the staff concluded that the inspection finding is appropriately characterized as White.
A Notice of Violation is included based on the licensees failure to meet Technical Specification 5.4.1, which requires, in part, that procedures shall be established, implemented, and maintained covering the applicable procedures recommended in Regulatory Guide 1.33. Regulatory Guide 1.33, states, in part, preventive maintenance schedules should be developed to specify replacement of parts that have a specific lifetime. Contrary to this requirement, the Licensee failed to replace electrolytic capacitors in components which could affect equipment reliability that have been in service for longer than their qualified life of 10 years. This resulted in a capacitor failure in the #2A EDG loss of off-site power timer card which caused the EDG to fail a surveillance test and be declared inoperable.
It should be noted that the licensee has not been specifically informed of the enforcement action.
