SEQUOYAH NUCLEAR PLANT (SQN) FACILITY NO. 0-330628 - UPDATE TO CLEANUP OF DIESEL SPILL ASSOCIATED WITH -UNDERGROUND STORAGE TANKS (USTs) IDENTIFIED JUNE 26, 2009 Enclosed for your review is an update to the cleanup of diesel fuel from piping associated with SQN's USTs, per your conversation with Stephanie Howard on April 1, 2010.

Due to the regulatory nature of some of the piping exposed, SQN requests permission to backfill the area of the cleanup as soon as possible.

Attachment 1 Approximately 200 yd 3 of diesel-contaminated soil from the spill has been removed from the spill location. SQN is in the process of obtaining a special waste permit for disposal of this soil. The Division of Underground Storage Tanks will be notified when the soil has been disposed.

All analytical results for the soil remaining in the excavation area are below the detection limit. Figures 1, 2 and 3 show the excavation location. Attachment 2 contains the analytical results. Due to the thickness of the concrete footer (approx. 1.25 ft) for the Diesel Generator Building and the location of the conduit bank and metal z-piling, SQN believes an adequate barrier existed to prevent the downward migration of diesel fuel to groundwater and that groundwater monitoring is not necessary.

It should be noted that the area in the immediate vicinity of the spill contains a significant amount of buried piping. This piping is safety related and critical to the operation of the plant. SQN's Final Safety Analysis Report (FSAR) requires that buried safety-related pipe be protected from tornado generated missiles. In this case, eighteen inches of conventional unreinforced concrete and a twelve inch cushion of either compacted sand or fine-grained earth fill over the pipe provide the protection from tornado. generated missiles. To support the cleanup of the leak from the fuel line, an evaluation was documented that if the river temperature is below 77 degrees F, this section of ERCW piping and therefore the missile shield is not required. Past trend data shows that the river temperature will start approaching 77 degrees F around the first week in June.

For these reasons, SQN requests permission to backfill the excavation area as soon as possible.
