ORDER (Denying Motion for Leave to File a Reply to Waiver Petition and Directing the Filing of a Brief)

On April 23, 2010, the San Luis Obispo Mothers for Peace (SLOMFP) filed a motion for leave to file a reply to the oppositions to their waiver petition.1 The applicant, Pacific Gas & Electric Company (PG&E) and the NRC Staff filed answers opposing the motion.2 For reasons stated in the answers, the motion is denied.

Nevertheless, the Board has questions as to whether, and how, the four-factor test articulated in Dominion Nuclear Connecticut, Inc. (Millstone Nuclear Power Station, Units 2 and 3), CLI-05-24, 62 NRC 551, 559-60 (2005), applies to this case. This test was discussed extensively in the answers by PG&E and the NRC Staff. In order to expedite the oral argument, SLOMFP is directed to file a brief, not to exceed 10 pages, covering its views as to whether, and 1

how, the Millstone four-factor test applies to this case. The brief should be filed on or before May 13, 2010. No further pleadings will be allowed.
