During its 569th meeting, February 4, 2010, the Advisory Committee on Reactor Safeguards (ACRS) discussed several matters and completed the following reports:

ACRS Review of Amendments to Previously Certified Designs, dated February 17, 2010 HIGHLIGHTS OF KEY ISSUES

1.

Draft ACRS Report on the NRC Safety Research Program The ACRS provides the Commission a biennial report, presenting the Committees observations and recommendations concerning the overall NRC Safety Research Program. During the February meeting, the Committee discussed its draft 2010 report to the Commission on the NRC Safety Research Program.

Committee Action The Committee plans to finalize the discussion of its draft report on the NRC safety research program during its March 2010 meeting. The report will be issued to the Commission shortly thereafter.

Draft Final Regulatory Guide 1.217, Guidance for the Assessment of Beyond-Design-Basis Aircraft Impacts The Committee met with representatives of the NRC staff and the industry to discuss the final draft of Regulatory Guide 1.217, Guidance for the Assessment of Beyond-Design-Basis Aircraft Impacts. This Regulatory Guide endorses a document prepared by the Nuclear Energy Institute (NEI), titled NEI 07-13, Revision 7, Methodology for Performing Aircraft Impact Assessments for New Plant Designs, dated May 2009. The methodology described in NEI 07-13 was developed to assist nuclear plant designers and license applicants in assessing the structural damage and fire effects caused by the impact of a large commercial aircraft on nuclear reactor structures.

Committee Action The Committee issued a letter report to the NRC Chairman on this matter, dated February 18, 2010, commending the efforts of the staff and the industry in developing a tractable methodology to address a technically challenging problem. The Committee concluded that the Regulatory Guide should be issued after incorporation of changes addressing how uncertainties in the analysis will be considered in demonstrating compliance with 10 CFR 50.150, and the potential shortcomings of NEI 07-13 regarding spurious actuations due to fires.

[Note: In order to protect unclassified security related/safeguards information, a large portion of this briefing was closed to the public. For the same reason, the ACRS letter report will not be made available to the public.]

Draft Final Revision 1 to Regulatory Guide 1.62, "Manual Initiation of Protective Actions" The Committee met with representatives of the NRC staff to discuss draft final Revision 1 to Regulatory Guide 1.62, Manual Initiation of Protective Actions. The staff provided an overview of the proposed changes to the regulatory guide which included: referencing the current IEEE Standard 603-1991 in addition to IEEE Standard 279-1971, changing "system level" to "division level" as the reference point for manual initiations, removing the "minimum-common-equipment guidance", and addressing manual initiation of digital control systems. Regulatory Guide 1.62 is also being revised to expand its scope with two new positions to include guidance for Diversity and Defense-in-Depth (D3) in accordance with NUREG-800 and Branch Technical Position 7-19, and to include an option to pursue either safety-related and non-safety manual actions separately, or as a single safety manual initiation. Also addressed by the staff was the resolution of public comments regarding the proposed regulatory guide.

Committee Action Due to the bad weather, which caused the ACRS meeting to be shortened to only one day, the Committee will issue a letter report to the NRC Chairman on this matter after the March 4-6, 2010, meeting.

Proposed Revisions to NUREG-1520, Standard Review Plan for Review of a License Application for a Fuel Cycle Facility The Committee met with representatives of the NRC staff to discuss the proposed modifications in draft final NUREG-1520 Revision 1, Standard Review Plan (SRP) for Review of a License Application for a Fuel Cycle Facility (FCF). The staff provided an overview of the proposed changes to the SRP. The Standard Review Plan is being updated to increase technical clarification and add guidance in areas where information was lacking or temporarily addressed by interim staff guidance. These changes also improve the linkage between review efforts and regulatory requirements, incorporate previous interim staff guidances, update references, and incorporate lessons learned from licensing experience. Also added was guidance on level-of-detail in descriptions of facility processes as well as items relied on for safety (IROFS). Four appendices were added to Chapter 3 (Integrated Safety Analysis) to provide guidance on risk topics such as inclusion of natural phenomena hazards, validation of initiating event frequencies, and clarification on the proper use of the semi-quantitative risk index methodology.

Committee Action The Committee issued a letter report to the NRC Chairman on this matter, dated February 22, 2010, concluding that NUREG-1520 Revision 1 should be issued. The Committee also recommended the NRC staff to continue to move in the direction of risk-informed regulations using analytic techniques and terminology consistent with other Agency applications.

Additionally, as follow-on activities for developing and reporting the results of Integrated Safety Assessments, attention should be given to: (1) fire-induced hot shorts and their potential to place systems in conditions other than a failsafe condition; (2) assessment of chemical hazards including accident sequences that may result in injuries as well as fatalities; and (3) treatment of the safety-security interface consistent with other ongoing regulatory initiatives.

RECONCILIATION OF ACRS COMMENTS AND RECOMMENDATIONS/EDO COMMITMENTS Due to the bad weather, which caused the ACRS meeting to be shortened to only one-day, this activity will now take place during the March meeting.

MINUTES OF THE 569th MEETING OF THE ADVISORY COMMITTEE ON REACTOR SAFEGUARDS ROCKVILLE, MARYLAND The 569th meeting of the Advisory Committee on Reactor Safeguards (ACRS) was held in Conference Room 2B3, Two White Flint North Building, Rockville, Maryland, on February 4, 2010. Notice of this meeting was published in the Federal Register on January 27, 2010 (72 FR 4428) (Appendix I). The purpose of this meeting was to discuss and take appropriate action on the items listed in the meeting schedule and outline (Appendix II). The meeting was open to public attendance.

Chairman's Report (Open)

Dr. Said Abdel-Khalik, Committee Chairman, convened the meeting at 8:30 a.m. In his opening remarks he announced that the meeting was being conducted in accordance with the provisions of the Federal Advisory Committee Act. He reviewed the agenda items for discussion and noted that no written comments or requests for time to make oral statements from members of the public had been received. Dr. Bonaca also noted that a transcript of the open portions of the meeting was being kept and speakers were requested to identify themselves and speak with clarity and volume.

II.

Draft ACRS Report on the NRC Safety Research Program

The ACRS provides the Commission a biennial report, presenting the Committees observations and recommendations concerning the overall NRC Safety Research Program. During the February meeting, the Committee discussed its draft 2010 report to the Commission on the NRC Safety Research Program. Report of the Planning and Procedures Subcommittee Meeting Due to inclement weather, which caused the ACRS meeting to be shortened to only one day, these activities did not take place during the March 2010 meeting.

C. Future Meeting Agenda Appendix IV summarizes the proposed items endorsed by the Committee for the 570th ACRS Meeting, March 4-6, 2010.

No formal comments on the proposed scope of the supplement to the GEIS will be accepted during the informal discussions. Stuyvenberg will need to be contacted no later than February 26, 2010, if special equipment or accommodations are needed to attend or present information at the public meeting, so that the NRC staff can determine whether the request can be accommodated.
