(Pilgrim Nuclear Power Station) April 7, 2010 ORDER (Rescheduling Telephone Conference to Address Future Course of Proceeding)
Intervenor Pilgrim Watch and the Town of Plymouth have filed motions to reschedule the telephone conference previously set for April 8, 2010, at 1:00 p.m., based on factors including unavailability of counsel, experts, and the recent heart surgery of the husband of Pilgrim Watch representative Mary Lampert and attendant complications.1 Entergy opposes the rescheduling, citing factors including asserted harm to Entergy from any continued delay in the case, and questioning the health issues raised by Pilgrim Watch.2 The Board finds that moving the telephone conference to a date in May as requested by Plymouth and Pilgrim Watch, and on which all parties will be available, is appropriate. The telephone conference is therefore reset for Tuesday, May 4, 2010, at 1:00 p.m. At this 1

conference we will address the status of the proceeding at this point, including as appropriate those issues previously listed, and in addition how to proceed in light of the pending Pilgrim Watch Motion for Reconsideration of CLI-10-11, 3 and whether the Commission has been requested to grant and has granted any stay of the proceedings before this Board pending its ruling on Pilgrim Watchs motion. All parties shall make every effort to have their experts present to participate in the conference as needed, particularly with regard to defining the issues for hearing, unless by the time of the conference the Commission has issued a stay of this proceeding.
