Dear Mr. Hughey,
In your letter of February 26, 2010, (Reference 1) you requested additional information be submitted, on the Peach Bottom docket, related to the ongoing review of a GE Hitachi Nuclear Energy (GEH) appeal of NRCs denial of a request for withholding certain information considered proprietary to GEH. Specifically, the NRC requested a GEH letter to Exelon (MJM-EXN-EXO-05-031) and any GEH corrective action or related information.
, Information Regarding Treatment of Fuel Parameters, contains the extent of pertinent information responsive to the NRC request. Because the information is of the type that is either GEH internal information or information between GEH and a customer, and is not of the type normally submitted to the NRC, GEH considers the information to be business confidential and proprietary information in its entirety. On this basis, no non-proprietary version is included. An affidavit describing the basis for withholding the information is provided as Enclosure 2.
