Jim, As discussed on the phone, the staff feels that this would be one possible path forward for the extension request. We will talk more about this the week of April 12 after your management has made a decision on a path forward.

In order for the staff to approve an extension for Point Beach, we need the following in a letter from the licensee:

1. A statement that they plan to retest, in 2010, the Point Beach strainer performance using assumptions consistent with the 2004 NRC SE on NEI 04-07 and the March 2008 staff review guidance, and that the testing will not rely on debris settling, as the NRC staff has not accepted this assumption for testing.
2. A statement that the licensee plans to make any plant modifications and submit any necessary supporting license amendment requests to address the strainer testing results. The completion dates for modifications already in the extension request are acceptable to the staff, but they would need to be fully inclusive of any modifications the testing in item 1 above shows to be necessary.
3. A statement that the licensee will resolve any remaining plant-specific RAIs not captured in item 1 above to the satisfaction of the NRC staff by August 31, 2010, and that their retest plans will reflect that resolution.

As we plan to state in the letters we send to licensees this spring, we continue to be open to discussions of alternative paths forward, but we need a clear backup plan to reach an end point with methods we consider acceptable.
