UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 March 23, 2010 Mr. Jack M. Davis Senior Vice President and Chief Nuclear Officer Detroit Edison Company Fermi 2 - 210 NOC 6400 North Dixie Highway Newport, MI 48166

SUBJECT:

FERMI 2 - CLOSEOUT OF BULLETIN 2007-01 "SECURITY OFFICER ATrENTIVENESS" (TAC NO. MD7600)

Dear Mr. Davis:

On December 12,2007, the U.S. Nuclear Regulatory Commission (NRC) issued Bulletin 2007 01, "Security Officer Attentiveness" (Agencywide Documents Access and Management System (ADAMS) Accession No. ML073400150).

Detroit Edison (the licensee) provided a response, dated February 11, 2008 (ADAMS Accession No. ML080460551), to Bulletin 2007-01. Once the licensee response was reviewed for Fermi Unit 2, the NRC staff identified a need for additional information. To gather that information, the NRC staff issued a Request for Additional Information (RAI) to the licensee on July 11, 2008 (ADAMS Accession No. ML081900514). The licensee provided a response to the RAI on August 7, 2008 (ADAMS Accession No. ML082270208), which included detailed descriptions of the administrative and managerial controls to deter and address inattentiveness and complicity among licensee security personnel at Fermi 2.

The NRC staff has reviewed the submitted information and has concluded that your response to Bulletin 2007-01 and the subsequent RAI is adequate for Fermi 2. The bases for the NRC's conclusion have been documented in a memorandum, "Security Bulletin 2007-01, Security Officer Attentiveness: Summary Report" (ADAMS Accession No. ML093440311). Based on this review, your response to the Bulletin 2007-01 is considered closed and no further action is requested of you at this time.

If you have any questions regarding this letter, please feel free to contact me at (301) 415-8371.

Sincerely, Mahesh Chawla, Project Manager Plant Licensing Branch 111-1 Division of Operating Reactor Licensing Office of Nuclear Reactor Regulation Docket No. 50-341 cc: Distribution via Listserv
