DONALD C. COOK NUCLEAR PLANT, UNITS 1 AND 2 - REQUEST FOR ADDITIONAL INFORMATION (SECOND ROUND) RE: LICENSE AMENDMENT REQUEST TO REVISE OPERATING LICENSES DPR-58 AND DPR-74, APPENDIX B, ENVIRONMENTAL TECHNICAL SPECIFICATIONS, PART II, NON-RADIOLOGICAL ENVIRONMENTAL PROTECTION PLAN (TAC NOS. ME0483 AND ME0484)
Dear Mr. Jensen:
By letter dated January 14, 2009, (Agencywide Documents Access and Management System (ADAMS) Accession No. ML090350210), Indiana Michigan Power Company (I&M, the licensee) submitted a license amendment request for Units 1 and 2 of the Donald C. Cook Nuclear Plant (CNP). The amendment proposes to modify the Operating Licenses, Appendix B, Environmental Technical Specifications, Part II, "Non-Radiological Environmental Protection Plan." I&M states that the proposed amendment is intended to delete obsolete program information to relieve CNP of the burden of preparing and submitting unnecessary environmental reports.
The NRC staff of the Environmental Branch in the Office of Nuclear Reactor Regulation has determined that additional information is required to complete the review.
The staff's request for additional information is provided below:
- 1. In Section 5.4.1, "Routine Reports," I&M provides justification for removing the Annual Environmental Operating Report by stating that the information contained in this report will be fully addressed through 10 CFR 50.72,10 CFR 50.90, and existing CNP programs. However, when the !\\IRC staff reviewed previous years' Annual Environmental Operating Reports, not all of the information contained in the report was readily locatable.
Please describe how (phone, letter, email, etc.) and to whom at the NRC (Operations Center, NRC Resident Inspector, Document Control Desk, DORL Project Manager, etc.) each of the following items in the Annual Environmental Operating Report is reported, and would continue to be reported, independent of the Annual Environmental Operating Report submittal:
- i. Non-routine reports ii. Herbicide Application Report iii. Molluscs Biofouling Monitoring Program Report

The NRC staff discussed the proposed RAI with Mr. Michael Scarpello during a phone calion March 4, 2010. Mr. Scarpello stated that he understood the intent of the proposed RAI and agreed that it may be formally issued. Mr. Scarpello agreed to provide a written response to the RAI no later than March 19,2010.
