The data, found in Enclosure I , covers the annual period ending December 31, 2009. As described in , a weakness was identified in the NSPM Fitness for Duty program that resulted in errors in the 2008 submitted data. Enclosure 2 contains the corrected 2008 data.

QF-0317, Rev 2 (DP-S-FFD-01) Page 4 of 6 Breakdown of Confirmed Positive Tests NSPM Nuclear conducted 48 tests of dilutes using the special analysis of dilute specimens permitted under 10 CFR 26.163(a)(2). One of these tests, profiled below under management actions, resulted in a positive.

Fitness For Duty Summary Management Actions

1. During the annual period ending December 31, 2009, Monticello Nuclear Generating Plant and Prairie Island Nuclear Generating Plant conducted 4,275 drug and alcohol tests in accordance with 10 CFR Part 26. Monticello Nuclear Generating Plant and Prairie Island Nuclear Generating Plant workers subject to random drug and alcohol testing are assigned to one of three pools: Prairie Island, Monticello, and Corporate Office. Random test rates for each pool for the annual period ending December 31, 2009 are as follows:

For the annual reporting period ending December 31, 2009, twenty (20) workers were denied nuclear access after testing positive for drugs or alcohol and one (1) worker was denied access for attempting to subvert the testing process by refusing to drug and alcohol test. By test type: fourteen (14) pre-access tests were positive and one ( I ) was a refusal to test, two (2) follow-up tests were positive, four (4) random tests were positive.

Pre-Access Positives One (1) contractor employee tested positive for alcohol.

Two (2) contractor employees tested positive for amphetamines.

Two (2) contractor employees tested positive for cocaine.

Eight (8) contractor employees tested positive for marijuana.

One (1) licensee applicant for access tested positive for alcohol.

The individuals listed above were denied access to NSPM nuclear facilities.

Follow-up Positives Two (2) contractor employees tested positive for alcohol.

Both individuals listed above were denied access to NSPM nuclear facilities.

Random Positives Three (3) contractor employees tested positive for marijuana. One of the positives was the result of the special analysis of dilute specimens permitted under 10 CFR 26.163(a)(2).

One (1) licensee employee tested positive for alcohol.

The individuals listed above were denied access to NSPM nuclear facilities. The licensee employee was subsequently reinstated following a determination of fitness for duty, including the establishment of appropriate follow-up requirements.

2. For the annual period referenced herein all blind specimens submitted to Monticello Nuclear Generating Plant and Prairie Island Nuclear Generating Plant's HHS-certified laboratory yielded expected results.
3. NSPM has analyzed program performance data for the annual period ending Form retained in accordance with record retention schedule identified in FP-G-RM-01.

The process used to validate the reporting of semi-annual performance data for the semi-annual period ending December 31, 2008 identified a weakness and corrective actions were initiated to enhance the NSPM Nuclear FFD Program. The process used to validate the reporting of semi-annual performance data for the semi-annual period ending December 31,2008 failed to identify two (2) positive tests, one (1) refusal to test and properly classify marijuana positives at the 50 nanograms (ng)/mL cutoff level. A corrected copy with changes in bold is included as Enclosure 2 of this submittal. Process enhancements include a pre-job brief for individuals performing data validation and an enhanced validation process.

Waivers For the reporting period ending December 31, 2009, Monticello and Prairie did not have any waivers of the work hour controls specified in 10 CFR 26.205(d)(I) through (d)(5)(i) for individuals described in 10 CFR 26.4(a).

Reportable Events There was one (1) reportable event involving a positive random drug test conducted on a contract individual involved in the collection or onsite testing of specimens

( I 0 CFR 26.4(g)(5)). In accordance with 10 CFR Part 26.719(b)(2)(i and ii), this declared positive constituted a violation of the NSPM Nuclear FFD Policy and was reported to the NRC Operations Center by telephone within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> after NSPM Nuclear discovered the violation.

During the six-month period ending December 31, 2008, Monticello Nuclear Generating Plant and Prairie lsland Nuclear Generating Plant conducted 1,754 drug and alcohol tests in accordance with 10 CFR Part 26. Monticello Nuclear Generating Plant and Prairie lsland Nuclear Generating Plant workers subject to random drug and alcohol testing are assigned to one of three pools: Prairie Island, Monticello, and Corporate Office. For the semi-annual reporting period ending December 31, 2008, eight (8) workers were denied nuclear access after testing positive for drugs or alcohol and one (1) worker was denied for refusing to test. 3. NSPM has analyzed program performance data for the six-month period ending December 31,2008. No program weaknesses were identified.
4. Monticello Nuclear Generating Plant and Prairie Island Nuclear Generating Plant continue to test for marijuana metabolites using an initial cutoff level of 50nglml.

This change was initiated on September 1, 1994, and communicated to the NRC by letter dated September 22, 1994.
