FITNESS FOR DUTY PROGRAM PERFORMANCE DATA FOR JANUARY THROUGH DECEMBER 2009 In accordance with 10 CFR 26.717, paragraph (e), this letter and enclosures provide the Tennessee Valley Authority's (TVA's) Fitness for Duty Program Performance Data for January through December 2009. Due to the recent rule change, this data is now submitted to NRC annually, by March 1 of the following calendar year. TVA's random testing rate of drug and alcohol use is performed in accordance with the requirements prescribed in 10 CFR 26.31 (d)(vii). contains a summary of TVA's Fitness for Duty performance data for January through December 2009. Enclosures 2, 3, and 4 contain management actions and a summary of the performance data for site personnel subject to 10 CFR 26 during the reporting period at each of TVA's licensed operating facilities. Enclosure 5 contains a summary of performance data for personnel located in the Corporate Offices (primarily, Chattanooga and Knoxville, Tennessee) and subject to 10 CFR 26. Enclosure 6 contains a list of 10 CFR 26.719 events that were reported during the reporting period.

FITNESS FOR DUTY PERFORMANCE DATA FOR JANUARY THROUGH DECEMBER 2009 The following summarizes testing results for personnel under TVA's Fitness for Duty Program that occurred during this reporting period:

I. TVA's "Re-screening of Specimens"

Reference:

TVA's letter to NRC dated February 28, 1997, "Fitness for Duty Performance Report" Summary By the above referenced letter, TVA informed the NRC of TVA's policy to rescreen specimens with creatinine levels of less than 20 mg/dl. During the reporting period, TVA's Nuclear Power Group screened 392 specimens at the lower cutoff level for marijuana. There were 5 positive tests identified from this group.

I1. Trends The confirmed positive test rate for all categories (pre-employment, pre-access, for-cause, post-accident, random, follow-up, and other) for this reporting period was 0.46 percent (e.g., 54 positive results out of 11,688 tests). The rate of random confirmed positives was 0.38 percent (e.g., 18 positive results out of 4,719 tests).

Note: The last reporting period covered the 6 month period from July 2008 through December 2008. Due to the recent rule change, the current reporting is 12 months from January through December for the reporting year. The report date is required to be submitted by March 1 of the following calendar year in accordance with 10 CFR 26.717, paragraph (e).

SUMMARY

OF MANAGEMENT ACTIONS AND FITNESS FOR DUTY PROGRAM PERFORMANCE DATA FOR BROWNS FERRY NUCLEAR PLANT In the pre-access test category, 8 contract employees (CEs) tested positive. The CEs were denied access, removed from site and returned to the contract company.

6 CEs were restricted from TVA's Nuclear Power Group work for 3 years.

2 CEs were permanently restricted from TVA's Nuclear Power Group work due to previous positive test results.

6 CEs requested that split specimen testing be performed. The split specimen tests reconfirmed the positive test results.

In the for-cause (observed behavior/reasonable suspicion) test category, 2 CEs tested positive. The 2 CEs were denied access, removed from site, returned to the contract company, and restricted from TVA's Nuclear Power Group work for 3 years.

1 contract employee (CE) was tested prior to March 31, 2009, and therefore requested a confirmatory blood alcohol test in accordance 10 CFR 26, Appendix A, Subpart B, "2.4 Specimen Collection Procedures," paragraph (g)(19). The option to request a confirmatory blood alcohol test was omitted from the rule (10 CFR 26) for positive tests results after March 31, 2009. The blood alcohol test reconfirmed the positive test results. Review of the CE's work did not identify any discrepancies.

1 CE requested an appeal. The appeal review upheld the original conclusion.

In the random test category, 3 CEs and 3 licensee employees (LEs) tested positive.

The CEs were denied access, removed from site, returned to the contract company, and restricted from TVA's Nuclear Power Group work for 3 years.

The LEs were denied access and removed from the site. 2 LEs were terminated due to their probationary employment status.

1 LE was suspended for a minimum of 14 days and referred to the Employee Assistance Program. This LE is currently suspended and being reassessed.

Reviews of the CEs' and LEs' work did not identify any discrepancies.

The 3 CEs requested that additional split specimen testing be performed. The split specimen tests reconfirmed the positive test results.

1 of the CEs was restricted from TVA's Nuclear Power Group work for 5 years because of uncooperative behavior during the Medical Review Officer's evaluation.

9 CEs requested that split specimen testing be performed. The split specimen tests reconfirmed the positive test results.

2 of the CEs requested an appeal. The appeal review upheld the original conclusion.

Also in the pre-access test category:

1 CE refused to continue the testing after providing an inadequate urine sample.

1 CE attempted to subvert the testing process by substituting another urine specimen for their sample. The CE requested that split specimen testing be performed. The split specimen tests reconfirmed the substitution.

The 2 CEs were denied access, removed from site, returned to the contract company, and permanently restricted from TVA's Nuclear Power Group work.

In the for-cause (observed behavior/reasonable suspicion) test category, 3 CEs tested positive.

2 CEs were denied access, removed from site, returned to the contract company, and restricted from TVA's Nuclear Power Group work for 3 years.

1 CE was denied access, removed from site, returned to the contract company, and permanently restricted from TVA's Nuclear Power Group work for attempting to subvert the testing process by substituting another urine specimen for their own.

2 CEs requested that split specimen testing be performed. The split specimen tests reconfirmed the positive test results.

Also in the pre-access test category, 1 contract employee (CE) refused to continue the testing after failing to provide an initial urine sample. The CE was denied access, removed from site, returned to the contract company, and permanently restricted from TVA's Nuclear Power Group work.

In the for-cause (observed behaviorlreasonable suspicion) test category, 4 CEs and 1 licensee employee (LE) tested positive.

1 CE was denied access, removed from site, returned to the contract company, and permanently restricted from TVA's Nuclear Power Group work due to having illegal drugs inside the protected area. Review of the CE's work did not identify any discrepancies. This event was reported to the NRC under 10 CFR 26.719 as Event No. 44752.

1 CE was denied access, removed from site, returned to the contract company, and permanently restricted from TVA's Nuclear Power Group work for attempting to subvert the testing process by substituting another urine specimen for their own. No review of work was conducted because the for-cause testing was based on an out of temperature test on a pre-access test.

1 CE was denied access, removed from site, returned to the contract company and restricted from TVA's Nuclear Power Group work for 3 years. The CE requested an appeal. The appeal review upheld the original conclusion. Review of the CE's work did not identify any discrepancies.

1 CE was denied access, removed from site, returned to the contract company and restricted from TVA's Nuclear Power Group work for 3 years. No review of work was conducted because the "for-cause" testing was based on a smell of alcohol prior to the pre-access test.

1 LE tested positive. The LE's unescorted access was revoked. The LE was removed from site, suspended for a minimum of 14 days, and referred to the Employee Assistance Program. The LE returned to work during the reporting period and was placed in the follow-up alcohol and drug testing program. Review of the LE's work did not identify any discrepancies.

In the random test category, 7 CEs and 3 LEs tested positive.

The 3 LEs' unescorted access was revoked. The LEs were removed from site, suspended for a minimum of 14 days, and referred to the Employee Assistance Program. 2 LEs returned to work during this reporting period and were placed in the follow-up alcohol and drug testing program. The other LE did not return to work during the reporting period. Reviews of the LEs' work did not identify any discrepancies. 1 of the LEs requested that split specimen testing be performed.

The split specimen test reconfirmed the positive test results.

6 of the CEs were denied access, removed from site, returned to the contract company, and restricted from TVA's Nuclear Power Group work for 3 years.

Review of their work did not identify any discrepancies.

1 CE was permanently restricted from TVA's Nuclear Power Group work because of previous positive test results. Review of the CE's work did not identify any discrepancies.

1 CE requested that split specimen testing be performed. The split specimen test reconfirmed the positive test results.

2 CEs with confirmed positive tests were supervisory personnel and therefore, were reported to the NRC (Event Report Nos. 45215 and 45531) in accordance with 10 CFR 26.719.
