February 25, 2010 RN 10-012 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT REGULATORY ACTION Licensee: Entergy Nuclear Operations EA-10-034 Vermont Yankee Nuclear Power Station Docket No. 50-271

Subject:

ISSUANCE OF A DEMAND FOR INFORMATION This is to inform the Commission that a Demand for Information (DFI) will be issued on or around March 1, 2010, to Entergy Nuclear Operations (Entergy). This DFI is being issued in response to verbal notification received from Entergy that action has been taken regarding certain Entergy employees, including some who were removed from their site positions at Vermont Yankee and placed on administrative leave, as a result of an internal independent investigation into alleged contradictory or misleading information provided by Entergy to the State of Vermont. While the NRC is not aware that any incomplete or inaccurate information was provided by Entergy to the NRC, some of the aforementioned individuals have responsibilities that involve decision-making communications that are material to the NRC or involve NRC-regulated activities. The NRC is issuing this DFI to confirm that the information provided by these individuals to the NRC is accurate and the impact of the organizational changes is assessed in performance of the regulatory program and the safety culture area.

This DFI will require Entergy to provide the following within 30 days of its issuance, in writing and under oath or affirmation: (1) information necessary to establish whether communications to the NRC over the past five years by the aforementioned individuals were complete and accurate, including but not limited to required reports to the NRC, interactions with NRC inspection staff, and submittals to support licensing decisions, including the license renewal process; (2) information related to any corrective actions or compensatory measures taken or planned to address identified instances where incomplete or inaccurate information was provided to the NRC; (3) a description of how Entergy is evaluating and responding to any adverse implications to the Vermont Yankee site safety culture as a result of their internal investigation, its findings, and the actions taken against the aforementioned employees; and (4) a description of how, in light of the organizational changes, Entergy is providing for appropriate implementation of NRC-regulated programs.

After reviewing Entergys response to the DFI, the NRC staff will consider whether further action is necessary to ensure compliance with regulatory requirements.
