RELAXATION OF SCHEDULE FOR IMPLEMENTING REQUIREMENTS OF ORDER FOR IMPLEMENTATION OF ADDITIONAL SECURITY MEASURES AND FINGERPRINTING FOR UNESCORTED ACCESS TO LA CROSSE BOILING WATER REACTOR INDEPENDENT SPENT FUEL STORAGE INSTALLATION
Dear Mr. Brasel:
On June 3, 2009, the U.S. Nuclear Regulatory Commission (NRC) issued an Order (EA-09-118) to Dairyland Power Cooperative (DPC) to require compliance with additional security measures (ASMs) related to Physical Protection and Access Authorization and Fingerprinting for the future independent spent fuel storage installation (ISFSI) at La Crosse Boiling Water Reactor. On June 22, 2009 (LAC-14069), DPC submitted its written response to the Order.
In the June 22, 2009, response, DPC stated that initial storage in the ISFSI would not begin until July 2010. The response also requested a relaxation of the ASM implementation schedule, as required by Section III.A of the Order. The NRC discussed concerns with DPCs initial response to the Order during an August 20, 2009, telephone conference. Subsequent to that conference, on November 2, 2009 (LAC-14085), DPC supplemented its June 22, 2009, response by consenting to the Order and amending its request for relaxation from Sections III.A, III.B.1, and III.C.1 of the Order. On November 24, 2009 (LAC-14088), DPC submitted a notification that the storage schedule has been delayed until June 2011. If the storage schedule is further delayed, DPC must provide the NRC with an updated schedule regarding ISFSI completion and proposed initial spent fuel loading.
Based on our review, the NRC staff finds DPCs supplemental responses to the Order acceptable. I find that you have demonstrated good cause for relaxation of specific provisions of the Order, and your request for relaxation of Sections III.A, III.B.1, and III.C.1 of the Order is therefore granted. However, implementation of the security measures required by the Order shall be completed 90 days before the first day that spent fuel is initially placed in the ISFSI.
This schedule must account for an on-site visit by the NRC staff at the La Crosse Boiling Water Reactor to verify compliance with the Order and implementation of the ASMs. As stated in the Order, DPC is required to notify the NRC when full compliance is achieved.
