Pursuant to 10CFR50.91(b) State consultation, notified you that we are processing an exemption to certain requirements of 10 CFR Part 50, Appendix J, Option B and an associated change to the Technical Specifications for main steamline isolation valve (MSIV) local leakage rate testing for Duane Arnold Energy Center. The associated change to the license of the Duane Arnold Energy Center (DAEC) revises Technical Specifications (TS) 5.5.12, (Primary Containment Leakage Rate Testing Program) Also, there is additional proposed Technical Specification change to Section 3.6.1.3 pertaining to the MSIVs, which does not require a corresponding exemption from 10 CFR Part 50, Appendix J The 3 actions are described in the Licensees application letter dated March 4, 2009. The letter may be accessed in ADAMS with the Accession Number ML090680040. The NRC tracks these actions with our assigned TAC Nos. ME0789 (the exemption), ME0873 (the amendment associated with the exemption), and ME 0874 (the amendment pertaining to the MSIVs, but not associated with an exemption).

I described the Licensees application and rationale that they provided for these actions. You stated that you had no comments.
