October 31, 2011 Response to Public Comments on Draft Regulatory Guide DG-3038, Standard Format and Content of License Applications for Plutonium Processing and Fuel Fabrication Facilities, Proposed Revision 1 of Regulatory Guide 3.39 A notice regarding the availability of Draft Regulatory Guide (DG)-3038 (proposed Revision 1 of Regulatory Guide (RG) 3.39 for public comment was published in the Federal Register (FR) on July 24, 2009 (74 FR 36780). The U.S. Nuclear Regulatory Commission (NRC) received comments from the following:
Janet Schlueter, Senior Project Manager Fuel Supply and Materials Licensees Nuclear Generation Division Nuclear Energy Institute (NEI) 1776 I Street NW, Suite 400 Washington, DC 20006 Comment Incorporated Notes NEI suggests that the NRC consider changing the title of DG-3038 from Standard Format and Content of License Applications for Plutonium Processing and Fuel Fabrication Facilities to Standard Review Plan for the Review of an Application for a Mixed Oxide Fuel Fabrication Facility in order to align this guide with its reference document, NUREG-1718, Standard Review Plan for the Review of an Application for a Mixed Oxide Fuel Fabrication Facility.
Partially Changed title to Standard Format and Content of License Applications for Mixed Oxide Fuel Fabrication Facilities to clarify the applicability of the regulatory guide to mixed oxide fuel fabrication facilities. This title also maintains consistency with the NRC approach to titling regulatory guides and will prevent any confusion that may arise from assigning the same title to this regulatory guide as that also used for NUREG-1718, Standard Review Plan for the Review of an Application for a Mixed Oxide Fuel Fabrication Facility.
As a result of the title change, staff also changed instances of the use of plutonium processing and fuel fabrication facilities within the body of the regulatory guide to mixed oxide fuel fabrication facilities. This will assure clarity and consistency within the regulatory guide.
