Dear Mr. DeYoung:
As attorneys for Consolidated Edison Company of New York, Inc. we transmit a letter from Mr. William J.
Cahill, Jr. to the Commission, together with a number of electrical drawings pertaining to the Indian Point Unit No. 3 facility. We request that Mr. Cahill's letter and all copies of the electrical drawings submitted herewith, or listed therein as previously submitted, be withheld from public disclosure.
The Commission's regulations, 10 C.F.R. § 2.790(d)
(1975), recognize that correspondence which "identif[ies] a licensee's or applicant's... security measures for the physi'cal protection of a licensed-facility" is to be considered as within 10 C.F.R. § 9.5(a)(4) (19-75) and thus exempt from disclosure. As is the case with physical security plans, these electrical drawings would be helpful to persons bent on industrial sabotage, and therefore fall within the reach of § 2.790(d).
Section 2.790(a) recognizes a balancing test and speaks of "a compelling reason for nondisclosure."
The continued physical security of the site on which two additional reactors are also located is such a reason which outweighs any public interest favoring disclosure.
