EXTENSION OF TIME TO REQUEST HEARING
Dear Mr. Pugh:
On December 22, 2009, the Nuclear Regulatory Commission (NRC) issued a Confirmatory Order to the Tennessee Valley Authority (TVA) in response to apparent violations of the NRC employee protection rule (10 CFR 50.7) identified during investigations conducted by the NRC Office of Investigations (OI) at their Browns Ferry Nuclear Plant (BFN). The Order published in the Federal Register on December 30, 2009, states that any person adversely affected by this Confirmatory Order, other than TVA, may request a hearing within 20 days of its publication in the Federal Register (January 19, 2010) or ask for an extension of time to request a hearing in writing with a statement of good cause for the extension. In a letter dated January 13, 2010, you requested a sixty day extension of time to request a hearing.
My staff has completed its review of your request. In accordance with the provisions of Section VI of the Order, I hereby grant approval to extend the time for you to request a hearing to March 22, 2010.
You are not required to respond to this letter; however, if you choose to provide a response, your response should not, to the extent possible, include any personal privacy, proprietary, or safeguards information so that it can be made available to the Public without redaction. In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter will be made available electronically for public inspection in the NRC Public Document Room or from the NRCs document system (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
