Pending before this Board is a Motion for Leave to Add a New Contention that was filed on October 26, 2009, by Hudson River Sloop Clearwater, Inc. (Clearwater) regarding the availability of off-site storage of spent fuel, and the possible environmental impact of indefinite on-site storage of spent fuel.1 After full consideration of the issues addressed in Clearwaters Motion, the NRC Staffs2 and Entergys3 Answers in Opposition to the Motion, the Answers in Support of the Motion filed by the State of New York,4 the State of Connecticut,5 the Town of 1 Hudson River Sloop Clearwater, Inc.s Motion for Leave to Add a New Contention Based Upon New Information (Oct. 26, 2009).

The Board does not request any additional briefing before we issue our decision on this matter as the relevant issues have been adequately addressed by the parties in the pleadings that have been filed.
