HUMBOLDT BAY POWER PLANT UNIT 3 - TWENTY-FIVE DAY RESPONSE TO NRC ORDER IMPOSING INCREASED CONTROLS (EA-09-204) AND TO NRC ORDER IMPOSING FINGERPRINTING AND CRIMINAL HISTORY RECORDS CHECK REQUIREMENTS FOR UNESCORTED ACCESS TO CERTAIN RADIOACTIVE MATERIAL (EA-09-205)

Dear Mr. Roller:

By letter dated December 17, 2009, you requested an extension of time to fully respond to the Orders until February 15, 2010, and an extension of time to implement measures to comply with the Orders. We have reviewed your request for an extension of time to fully respond to the Orders and determined that your justification is reasonable. We are hereby granting your request for an extension of time to fully respond to the Orders until February 15, 2010.

Regarding your request for an extension of time to implement measures to comply with the Orders, we believe that it is premature to extend the implementation period until you have determined how you will comply with the Orders, therefore we are deferring a decision on that request until you have provided your full response and provided a specific date for compliance.

We also note that by separate letter dated December 17, 2009, you certified a Trustworthiness and Reliability Official, satisfying requirement III.A.2 of EA-09-205.
