20545 4TES O CT 1 3 1971 Files AMENDMENT NO.* 10 TO INDEN~NITY AGREEMENT-NO.* B-19

-CONSOLIDATED.EDISON COMPANY <INDIAN POINT UNIT NO.

2) 50-247 The Division of Reactor Licensing intends to issue Facility License No. DPR-26. to the Consolidated Edison Company providing for fuel loading.

and subcritical testing of the Indian Point Unit No.

2 pending completion of other items at which time it will be -licensed to operate.

Effective on the date of the'issuance of DPR-26, we intend-to amend Indemnity Agreement No. B-19 to delete coverage for material license SNM-li08 which provided for preoperational storage of fuel for the reactor (Unit 2) under construction pursuant to Construction Permit CPPR-21 and substitute instead coverage under License DPR-26 and modify the indemnified location to be that of the metes and bounds site provided to us by Leonard Trosten's letter of December 10, 1970.

Financial protection of $82 million is already in effect covering Indian Point Unit No. 1 and therefore no increase in financial protection is required.

The indemnity fee for the new license should remain at the minimum fee of $100 per year inasmuch as criticality and operations are not yet authorized.

At such time as operation is authorized under DPR-26 we will notify the Controller to increase the indemnity fee.
