Dear Mr. Heacock:

Enclosed for your information is the synopsis of the Nuclear Regulatory Commission (NRC)

Office of Investigations (OI) completed report regarding discrimination against a former contracted health physics technician.

OI determined that there was insufficient evidence to substantiate the allegation that a former Contracted Senior Health Physics (HP) Technician at Surry Nuclear Power Station (Surry), had been discriminated against as a result of raising safety concerns.

In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter and its enclosure will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRCs document system (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/NRC/ADAMS/index.html (the Public Electronic Reading Room).

NOT FOR PUBLIC DISCLOSURE WITHOUT APPROVAL OF FIELD OFFICE DIRECTOR, OFFICE OF INVESTIGATIONS, REGION II OFFICIAL USE ONLY - OI INVESTIGATION INFORMATION SYNOPSIS OF OI Case NO. 2-2009-020 This investigation was initiated by the U.S. Nuclear Regulatory Commission (NRC), Office of Investigations (OI), Region II (RII), on March 12, 2009, to determine if a former Contracted Senior Health Physics (HP) Technician, at Surry Nuclear Power Station (Surry), was discriminated against as a result of raising safety concerns. Specifically, the former Contracted Senior HP Technician asserted that in the September 2000 time frame, during a Surry Nuclear Power Plant Unit 2 outage, a reactor vessel head was bounced against a reactor containment wall, resulting in approximately 30 individuals becoming contaminated. The former Senior Contracted HP Technician informed his supervision that he believed that this incident (the contaminations) should have been documented in the reportable personnel contamination log vs. the non-reportable personnel contamination log that Surry had utilized.

Based upon the evidence developed during the course of this investigation, OI did not substantiate the allegation that the former Contracted Senior HP Technician was discriminated against for raising safety concerns.
