Steve, By letter dated December 8, 2008, FPL Energy Point Beach, LLC, submitted a license amendment application for Point Beach Nuclear Plant Units 1 and 2 to revise the current licensing basis to implement the alternate source term through reanalysis of the radiological consequences of the FSAR Chapter 14 accidents.

The NRC staff has reviewed the information provided and determined that in order to complete its evaluation, additional information is required. We would like to discuss the questions, in draft form below, with you in a conference call.

This e-mail aims solely to prepare you and others for the proposed conference call. It does not convey a formal NRC staff position, and it does not formally request for additional information.

DRAFT Based on a previous phone call with the licensee regarding PBNP AST submittal, it is NRC's understanding that, for both the control room ventilation system and the primary auxiliary building ventilation system, a 7-day allowed outage time is needed for maintenance. During this time, both trains of each system will be out of service. Is this true? - if so why?

NRC staff assessment of quantifiable design basis accident consequences during this outage time appears to yield unacceptable doses. However, the probability of a design basis accident during this same time is un-quantified; therefore, the risk of the newly proposed TS outage time is unknown. Given the un-quantified and unknown risk, the NRC staff has determined that additional information is needed for the completion its safety evaluation.

Therefore:

a) Please provide additional information describing PBNP's proposed AST analyses results with and without credit for the control room ventilation system. Please include a discussion of the margin, available compensatory measures, etc.

b) Given that during control room ventilation system allowed outage time of 7 days meeting the CR dose criterion is questionable, please provide additional information describing the basis for the proposed removal the PBNP licensing

basis compensatory action to use potassium iodide (KI) in the event of a design basis accident.

c) Please provide additional information describing PBNP's proposed AST analyses results with and without credit for the primary auxiliary building ventilation system. Please include a discussion of the margin, available compensatory measures, etc.

d) Please provide additional information describing the expected frequency of the maintenance activities that would be undertaken during the allowed outage times for both of these systems. Please include a discussion of the controls that would ensure that both of these systems would not be in their respective allowed outage times concurrently.
