Dear Administrative Judges:

In my letter to the Atomic Safety and Licensing Board (Board) of August 12, 2009, I notified the Board and parties that the NRC Staff (Staff) had published the Final Safety Evaluation Report (SER) concerning the Indian Point Units 2 and 3 license renewal application. In addition, I stated that the Staff will provide a bound paper copy of the SER to the Board and parties when it is published, following the ACRS meeting scheduled to be held in September 2009.

The Staff wishes to inform you that it has now published the bound version of the Final SER, a copy of which is enclosed herewith. The enclosed SER incorporates a limited number of editorial and typographical corrections; further, the enclosed SER includes a new Section 5 that describes the Advisory Committee on Reactor Safeguards (ACRS) committee meeting of September 10 - 12, 2009, and reproduces the ACRS letter of September 23, 2009. In that letter, the ACRS concluded as follows:

We agree with the staff that there are no issues related to the matters described in 10 CFR 54.29(a)(1) and (a)(2) that preclude renewal of the operating licenses for IP2 and IP3. The programs established and committed to by Entergy provide reasonable assurance that IP2 and IP3 can be operated in accordance with their current licensing bases for the period of extended operation without undue risk to the health and safety of the public. The Entergy application for renewal of the operating licenses for IP2 and IP3 should be approved.
