Dear Mr. Pardee,

By letter to the Nuclear Regulatory Commission (NRC) dated August 7, 2009 (Agencywide Documents Access and Management System Accession No. ML092220301), Exelon Generation Company, LLC submitted a request to use specific provisions from a later edition of the American Society of Mechanical Engineers Boiler and Pressure Vessel Code,Section XI, for the subject plants.

The NRC staff is reviewing your submittal and has determined that additional information is required to complete the review. The specific information requested is addressed in the enclosure to this letter. During a discussion with your staff on December 8, 2009, it was agreed that you would provide a response on or before January 22, 2009.

The NRC staff considers that timely responses to requests for additional information help ensure sufficient time is available for staff review and contribute toward the NRC's goal of efficient and effective use of staff resources. REQUEST FOR ADDITIONAL INFORMATION REGARDING USE OF SPECIFIC PROVISIONS FROM A LATER EDITION OF THE AMERICAN SOCIETY OF MECHANICAL ENGINEERS BOILER AND PRESSURE VESSEL CODE, SECTION XI, EXELON GENERATION COMPANY, LLC BRAIDWOOD STATION, UNIT 1 AND UNIT 2 BYRON STATION, UNIT 1 AND UNIT 2 LASALLE COUNTY STATION, UNIT 1 AND UNIT 2 LIMERICK GENERATING STATION, UNIT 1 AND UNIT 2 PEACH BOTTOM ATOMIC POWER STATION, UNIT 2 AND UNIT 3 DOCKET NOS. 50-456, 50-457, 50-454, 50-455, 50-373, 50-374,50-352,50-353,50-277, and 50-278 By letter dated August 7,2009, (Agencywide Documents Access and Management System Accession No. ML092220301), Exelon Generation Company, LLC, (the licensee) submitted a request for Nuclear Regulatory Commission (NRC) review and approval. The licensee requested to use specific provisions from a later edition of the American Society of Mechanical Engineers Boiler and Pressure Vessel Code (ASME Code),Section XI. The licensee's request pertains to Class 1, 2, 3, and MC components subjected to surface examination using magnetic particle examination and liquid penetrant examination. The code of record for the current 10-year in-service inspection interval is based on the 2001 Edition through 2003 Addenda to the ASME Code,Section XI.

The NRC staff has reviewed the information provided by the licensee and has determined that additional information is needed in order to complete its review.

Title 10 of the Code of Federal Regulations Section 50.55a(g)(4)(iv) states, in part, that portions of editions or addenda may be used prOVided that all related requirements of the respective editions or addenda are met.

1. The licensee requested to use the 2004 Edition of the ASME Code,Section XI, IWA-2221 (c) and IWA-2222(b) for Class 1,2, and 3 components and IWE-2100 for Class MC components sUbjected to surface examination using magnetic particle examination and liquid penetrant examination. Discuss whether all related requirements of the respective editions or addenda will be met.
