FERMI POWER PLANT, UNIT 2 NRC PRE-DECISIONAL ENFORCEMENT CONFERENCE
Dear Mr. Davis:
This letter confirms our plans as discussed between members of our staffs to hold a pre-decisional enforcement conference to discuss one apparent violation being considered for escalated enforcement. The details regarding the issue was conveyed to you in our letter dated November 12, 2009, and its accompanying NRC Inspection Report, 05000341/2009-010 (ML093200423). The meeting will begin at 1:00 p.m. CST on Monday, December 14, 2009, at the U. S. Nuclear Regulatory Commission Region III Office, 2443 Warrenville Road, Suite 210, Lisle, IL 60532. This conference will be open to public observation in accordance with Section V of the NRC Enforcement Policy.
The current Enforcement Policy is included on the NRCs Web site at:
http://www.nrc.gov/about-nrc/regulatory/enforcement/enforce-pol.html.
The decision to hold a pre-decisional enforcement conference does not mean that the NRC has determined that a violation has occurred or that enforcement action will be taken. This conference is being held to obtain information to assist the NRC in making an enforcement decision. This may include information to determine whether a violation occurred, information to determine the significance of a violation, information related to the identification of a violation, and information related to any corrective actions taken or planned. The conference will provide an opportunity for you to provide your perspective on these matters and any other information that you believe the NRC should take into consideration in making an enforcement decision.
You will be advised by separate correspondence of the results of our deliberations on this matter.
