Gentlemen:
Pursuant to 10 CFR 26.719, "Reporting Requirements," part (c), "Drug and Alcohol Testing Errors," Wolf Creek Nuclear Operating Corporation (WCNOC) is submitting the following report of an investigation into a testing error associated with the WCNOC Fitness for Duty (FFD)
Program.
On September 28, 2009, WCNOC's Medical Review Officer (MRO) requested a retest of a sample taken on September 23, 2009. When the contracted Health and Human Services (HHS) certified laboratory submitted the sample to a second HHS certified laboratory the entire sample was sent rather than preparing an aliquot of the single specimen. In addition, because the entire specimen had been shipped, the tamper evident seal was broken which made it unusable for a retest. The second HHS certified laboratory rejected the sample and canceled the test. WCNOC's MRO reported the result as "canceled" and informed WCNOC that another collection taken under direct observation would be required. The contracted HHS laboratory has reviewed this incident and their report, Enclosure 1, dated October 14, 2009, documents their review and corrective actions.
