Possession-Only License No. DPR-45 Supplemental Response to Order of June 3, 2009, MOdifying Licenses

REFERENCE:

(1) Letter of June 3, 2009, NRC to DPC, and attached Order for Additional Security Measures at the La Crosse Boiling Water Reactor Independent Spent Fuel Storage Installation, EA-09-118.

(2) Letter of June 22, 2009, DPC to NRC, and attached Response to EA-09-118, containing the Additional Security Measures (ASM's) for physical protection of the Independent Spent Fuel Storage Installation (ISFSI) and access authorization and fingerprinting.

The purpose of this letter is to supplement DPC's response to EA-09-118. During a phone conference between the NRC and DPC on August 20, 2009, concerning DPC's response to NRC Order EA-09-118, DPC agreed to provide a supplemental response to clarify our intent to meet the requirements of the Order. DPC hereby consents to the Order with specific requests for relaxation as noted below.

DPC requests relaxation from item III-A of the Order, specifically for implementation to be completed in 180 days of the date of the Order (November 29, 2009) due to the fact A Touchstone Energy Cooperative __*:*

Document Control Desk Page 2 November 2, 2009 that fuel will not be transferred to the ISFSI until July 2010 at the earliest. DPC requests to complete implementation of the requirements no later than 90 days prior to the first day that spent fuel is initially placed in the ISFSI. We had proposed in our initial response that we be allowed to complete implementation before the first day that spent fuel is initially placed in the ISFSI.

DPC requests relaxation from item III-B. 1 of the Order. There are measures for which further analysis is necessary in order to ensure compliance with the ASM requirements.

DPC has contracted the services of a qualified vendor to perform these analyses, and the results are expected to be completed by November 29, 2009. Upon receipt of the analyses, DPC will promptly submit to the NRC the results of the analyses and the actions that we propose to comply with the security measures, together with an implementation schedule.

DPC requests relaxation from item III-C. 1 of the Order in terms of timing to submit a schedule for complete compliance with the Order. All requirements of the Order will be completed no later than 90 days prior to the first day that spent fuel is initially placed in the ISFSI. DPC will promptly notify the NRC as each requirement is completed and when full compliance is achieved.
