SUMMARY

OF THE LICENSE RENEWAL MEETING BETWEEN THE U.S. NUCLEAR REGULATORY COMMISSION STAFF AND THE NUCLEAR ENERGY INSTITUTE The U.S. Nuclear Regulatory Commission staff (NRC or the staff) and representatives of the Nuclear Energy Institute (NEI) met on October 28, 2009, in a Category 2 public meeting, to discuss generic license renewal topics and activities. Enclosures to this letter are: (1) list of meeting participants and (2) meeting agenda. A summary of the meetings discussions follows.

1. Generic Environmental Impact Statement (GEIS) Status
a. NRC staff stated that six public meetings to discuss the draft GEIS were recently completed. The opportunity to comment on the GEIS has been extended to January 12, 2010. Comments are being solicited for input on how to implement the final version of the rule. The final rule that revises the GEIS is expected to be issued in 2011.
2. Status of License Renewal Interim Staff Guidance (LR-ISG)
a. Boral Degradation in Spent Fuel Pool (LR-ISG-2009-01)

NRC staff stated that this draft LR-ISG has been delayed to complete implementation of the backfit discussion outlined in the revised LR-ISG process (LR-ISG-2007-01). This draft ISG is scheduled to be issued for a 30 day public comment period in November 2009. NRC is also evaluating how the issues discussed in this LR-ISG will affect current renewed license holders. An Information Notice referencing the Palisades operating experience with blistering and degradation of Boral plates in spent fuel pools was issued on October 28, 2009 (ADAMS ML093010229). This LR-ISG will provide an acceptable license renewal Aging Management Program (AMP) to ensure that Boral plates in the spent fuel pool will perform their safety function during the period of extended operation.

There was a discussion regarding how the degradation of Boral in spent fuel pools will be addressed under Part 50 as a current operating issue.

b. Revision to the LR-ISG Process (LR-ISG-2007-01)

NRC staff stated that the final LR-ISG was issued in the Federal Register on August 17, 2009 (ADAMS ML091950069) and has been posted on the public website.

c. Electrical Cable Connections Not Subject to 10 CFR Part 50.49 Environmental Qualification Requirements (LR-ISG-2007-02)

NRC staff stated that this final LR-ISG is on track to be issued in November 2009.

This LR-ISG reflects comments received from the industry and will clarify the one-time inspection of a representative sample of electrical connections. NRC staff is finalizing this LR-ISG in accordance with the revised LR-ISG process (LR-ISG-2007-

01) format.
3. Performance of One-Time Volumetric Inspection of Socket Welds in Small Bore Piping
a. The NRC staff stated that AMP XI.M35 recommends a one-time volumetric inspection of small bore piping. This AMP is applicable to plants that have not demonstrated issues with socket welds in small bore piping. Plants with these issues should use a plant-specific program. NRC believes that appropriate inspection requirements for this issue are currently addressed in the Generic Aging Lessons Learned (GALL) report.

Industry stated that the GALL report does not address small bore piping socket welds and that industry follows the American Society of Mechanical Engineer code requirements for visual inspections of these types of welds. Industry also requested that the NRC share their operating experience on this issue. A meeting will be coordinated to discuss this issue in the near future.

4. Status of GALL
a. The NRC staff stated that work is progressing on the GALL report update initiative.

The staff plans to post available draft GALL report information on the license renewal public web page by the end of December 2009. This will include a majority of the AMPs and select Aging Management Review (AMR) line items. The staff plans to engage with industry discipline specific groups in early 2010 to discuss the draft material. The staff plans to issue the draft updates for the GALL report and Standard Review Plan for License Renewal for a 45 day formal public comment period in early April, 2010. A public workshop to discuss the draft updates is planned for late April, 2010. Following receipt and resolution of public comments on the draft updates, the staff will prepare the final revisions of the license renewal guidance documents for planned issuance in December, 2010.

NEI stated that they are providing additional comments on the draft update for the GALL report.

5. Regional Counterparts Meeting Summary
a. NRC staff stated that headquarters and regional staff had productive discussions regarding updates to Inspection Procedure 71003, lessons learned, audit coordination, and preparation for license renewal presentations at the Regulatory Information Conference in 2010.
6. New Topics
a. NRC staff discussed progress on the international GALL.
b. NEI asked about the status of the revision to Regulatory Information Summary (RIS) 07-16, Implementation of the Requirements of 10 CFR 54.37(b) for Holders of Renewed Licenses. The NRC stated that they are currently reviewing the revision to this RIS.
7. Public Participation No member of the public provided comments or asked questions at the meeting.

Future meetings are tentatively scheduled for February 24, May 26, August 25, and November 17, 2010.
