Correction to recent RAI on the Spent Fuel Pool Amendment As I mentioned to Fritzie on October 26, 2009, the staff realized that the final paragraph to the spent fuel pool RAI that was sent to you as a draft on October 6, 2009, and officially on October 22, 2009, was missing. While the wording was left off the correspondence, the message conveyed in the paragraph was discussed during our discussion on October 8, 2009. Please take the wording below into consideration as you prepare your response. I will be issuing a correction letter to official RAI to ensure the staff's question, in its entirety, can be easily found on the docket. I would like to maintain that you provide your response within 30 days from the date of the October 22, 2009, letter. Please contact me if you have any questions. Thanks.

"In summary, the staff finds that the current Point Beach analysis does not provide the staff with reasonable assurance that Point Beach fuel storage will comply with the regulatory limit of keff less than 1.0 under unborated conditions. For the staff to continue its review, the licensee should consider resubmitting an analysis that restores the full 0.5% k analytical margin for the proposed storage configurations, incorporating any identified non-conservatisms. Alternatively, the licensee may attempt to regain the analytical margin by identifying and quantifying the conservatisms in their analysis. However, this approach usually results in a more lengthy review with additional RAIs to substantiate the identified conservatisms."
