SOUTH TEXAS PROJECT UNITS 1 AND 2 -

SUMMARY

OF TELEPHONE CONFERENCE RE: VERBAL AUTHORIZATION FOR RELIEF REQUEST RR-ENG-2-53 (TAC NOS. ME2329 and ME2330)

This memorandum summarizes the telephone discussion on October 16, 2009, between the U.S. Nuclear Regulatory Commission (NRC) staff and STP Nuclear Operating Company (STPNOC, the licensee). The discussion was in regard to the licensee=s request for relief RR-ENG-2-53 for South Texas Project (STP), Units 1 and 2. Participants in the discussion included W. Harrison, P. Walker, M. Ruvalcaba, and J. Stauber (STPNOC), and J. Tsao, J. Collins, M. Markley, and F. Lyon (NRC).

By letter dated September 23, 2009 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML092720458), STPNOC submitted a request for STP, Units 1 and 2, to use an alternative from certain American Society of Mechanical Engineers Boiler and Pressure Vessel Code (ASME Code) requirements under the provisions of Title 10 of the Code of Federal Regulations Section 50.55a(a)(3)(i). ASME Code,Section XI, 1995 Edition through 1996 Addenda, Appendix I, Article I-2110(b), requires ultrasonic examination of the reactor pressure vessel (RPV) shell-to-flange weld in accordance with ASME Code,Section V, Article 4.

Specifically, STPNOC requested permission to perform the RPV shell-to-flange weld examination with procedures, equipment, and personnel qualified to the Performance Demonstration Initiative requirements of ASME Code,Section XI, 1995 Edition through 1996 Addenda, Appendix VIII, Supplements 4 and 6, as modified by 10 CFR 50.55a.

STPNOC's proposed alternative with regard to the RPV shell-to-flange weld examination was documented in the licensees September 23, 2009, letter. The licensee provided additional information in response to NRC staff questions, as documented in e-mails dated October 15, 2009 (ADAMS Accession Nos. ML092880392 and ML092880990). The licensee agreed to supplement its request for relief by letter to the NRC to include the information contained in the e-mails.

The NRC staff has completed its review of the information provided by the licensee. The licensee provided information in its submittal to demonstrate that the proposed alternative provides an acceptable level of quality and safety.

Therefore, in accordance with 10 CFR 50.55a(a)(3)(i), RR-ENG-2-53 is verbally authorized by the Acting Chief, Piping and NDE Branch, Division of Component Integrity, and the Chief, Plant Licensing Branch IV, Division of Operating Reactor Licensing, for the second 10-year inspection interval, which ends for Unit 1 on September 25, 2010, and for Unit 2 on October 19, 2010, in accordance with the information provided in the licensee=s letter dated September 23, 2009, and e-mail dated October 15, 2009. The NRC's written final safety evaluation will follow as a matter of routine.

The licensee had no additional comments or questions.
