STATUS OF U.S. NUCLEAR REGULATORY COMMISSION REVIEW AND ENDORSEMENT OF NEI 06-06, FITNESS FOR DUTY PROGRAM GUIDANCE FOR NEW NUCLEAR POWER PLANT CONSTRUCTION SITES
Dear Mr. Roe:
By letter dated August 5, 2009, the Nuclear Energy Institute (NEI) provided NEI 06-06, revision 5, Fitness for Duty Program Guidance for New Nuclear Power Plant Construction Sites, for NRC staff review and endorsement. Both your letter and NEI 06-06 can be accessed through the NRCs Agencywide Documents Access and Management System (ADAMS) at Accession Numbers ML092430013 and ML092430016, respectively. NEI 06-06 can also be viewed on the NRCs website at http://www.nrc.gov/reactors/operating/ops-experience/fitness-for-duty.html. This recent revision updated NEI 06-06, revision 4, which you submitted on February 13, 2009, and incorporated the majority of the staff comments provided to you by NRC letter dated July 6, 2009 (ADAMS Accession No. ML091730415).
The staff has reviewed NEI 06-06, revision 5, and found it sufficient to pursue formal NRC endorsement via the NRCs Regulatory Guide process with possible clarifications, additions, and/or exceptions.
In the interim, for current and prospective applicants for a combined license under 10 CFR Part 52 or a construction permit or limited work authorization under 10 CFR Part 50, the NRC staff has determined that NEI 06-06, Revision 5, is acceptable for use as a reference in the development of site-specific applications. Additionally, current and prospective applicants, if referencing NEI 06-06, Revision 5, should consider the enclosed information to inform their submittal.
