NATIONAL INSTITUTE OF STANDARDS AND TECHNOLOGY TO DOE SAVANNAH RIVER SITE, (TAC D92044)
Dear Dr. Richards:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter of May 27, 2009, which requested the NRC approve two routes for transporting spent nuclear fuel (SNF) from the National Institute of Standards and Technology, to the Savannah River Site, Aiken, South Carolina (NRC Routes No. 187 and 232).
The NRC has reviewed your application and concluded that the information satisfies the requirements of Title 10 of the Code of Federal Regulations (CFR) Part 73.37. Specific details of Route No.187 are enclosed. Specific details of Route No. 187 combined with additional Safeguards Information (SGI) are also enclosed. Similarly, specific details of Route No. 232 are enclosed. Specific details of Route No. 232 combined with additional Safeguards Information (SGI) are also enclosed. Enclosures 2 and 4 will not be released to the public and you should protect them in accordance with the requirements of 10 CFR 73.21. Approval of Routes No.
187 and 232 will expire September 30, 2014. The NRC expects your periodic review and update of the emergency phone numbers associated with this route. Changes to emergency contact numbers do not qualify as a route deviation or change.
NRC issued Additional Security Measures (ASMs) for the transportation of SNF on October 3, 2002, for NRC licensees who ship greater than 100 grams of SNF. Licensees are required to comply with the requirements of 10 CFR 73.37 and these ASMs when shipping SNF.
Licensees are also required to comply with U.S. Departments of Transportation and Homeland Security regulations on the shipment of hazardous materials.
In addition, the NRC also issued Regulatory Issue Summary (RIS) 2002-12I, Rev. 1, on October 3, 2002, Transportation of Spent Nuclear Fuel Greater than 100 Grams - NRC Threat WARNING: Violation of Section 147 of the Atomic Energy Act, Safeguards Information is subject to Civil and Criminal Penalties When separated from Enclosures 2 & 4, this document is DECONTROLLED.
SAFEGUARDS INFORMATION SAFEGUARDS INFORMATION Advisory and Protective Measures System. The RIS advised licensees to consider various recommendations to be taken in conjunction with changes to the national or transportation-sector threat levels, when shipping spent nuclear fuel.
If you are requested by State officials to deviate from a portion of the approved route (due to highway construction activities or other exigent conditions), please provide details of the deviation to Ms. Adelaide Giantelli, as soon as possible.
