BELLEFONTE NUCLEAR PLANT UNITS 1 AND 2 - STAFF PLAN FOR ASSESSMENT OF TRANSITION TO DEFERRED PLANT STATUS (TAC NOS. ME1904 AND ME1905)

The Office of Nuclear Reactor Regulation (NRR) and Region II have jointly prepared the Plan for Staff Assessment of Transition of Bellefonte Nuclear Plant [BLN] Units 1 and 2 from Terminated to Deferred Plant Status, and have coordinated the Plan with the Office of New Reactors. The document describes the staffs plan for implementing the Nuclear Regulatory Commission (NRC) Order dated March 9, 2009, to ensure to the satisfaction of the Director of NRR that the Tennessee Valley Authority (TVA) has complied with the guidance and provisions of the Commissions Policy Statement on Deferred Plants. This Plan is consistent with the information provided to you in a briefing on July 21, 2009. The Plan is enclosed for your information.

By letter dated August 10, 2009, TVA informed the NRC that it has established the necessary programs, policies and procedures to warrant BLN Units 1 and 2 being placed in deferred status consistent with the Policy Statement and requested NRC approval to place them in deferred plant status. The NRC staff will use the plan to assess and inspect TVAs compliance with Section III.A of the Policy Statement. On the basis of the assessment and inspection, the staff will provide its recommendation about the acceptability of TVAs request. The Director of NRR will then make his final determination.

The Office of General Counsel has no legal objections with the document.
