U. S. Nuclear Regulatory Commission Page 2 August 31, 2009 On August 11, 2009, TVA met with the NRC staff to discuss a path forward on 10 CFR 50, Appendix R, "Fire Protection Program for Nuclear Power Facilities Operating Prior to January 1, 1979," with regard to COP credit. During that meeting TVA indicated that the proposed approach for COP would be submitted to the NRC on August 28, 2009. In the Reference 3 letter, TVA informed the NRC that submittal of the proposed approach for COP would be delayed until August 31, 2009.
The proposed approach for COP is currently being reviewed again by TVA Senior Management. Therefore, and as agreed during a telephone conversation between E. Brown of the NRC and G. Arent of TVA on August 31, 2009, TVA will notify the NRC as soon as we establish a submittal date for the proposed COP approach.
