Dear Mr. McCullum,
This letter responds to your letter of August 29, 2009, to Brian Benney of my staff, regarding the Nuclear Regulatory Commission (NRC) staffs review of the Department of Energys License Application for authorization to build a repository at Yucca Mountain. As you know, the NRC staffs independent safety review is in progress. This review will include careful consideration of the items you mention, and once our review is complete, we will document our results in a Safety Evaluation Report that will be made available to the public.
