Letter from NSPM to NRC, "Request For Approval To Use A Subsequent ASME Code Edition And Addenda For The Second IWE Interval", dated July 29, 2009 Federal Register Notice, 73FR52730, "Industry Codes and Standards; Amended Requirements; Final RuleJ', dated September 10, 2008 Based on discussions with the NRC staff on August 4, 2009, Northern States Power Company, a Minnesota corporation (NSPM) is withdrawing its request, dated July 29, 2009, to use a subsequent ASME Code Edition and Addenda for the second IWE interval for the Prairie Island and Monticello Nuclear Generating Plants.
NSPM initially interpreted language in the September 10, 2008 Federal Register referring to the "code of record for the IS1 interval in question" to be referring to the code of record for the overall IS1 program. The staff indicated in an August 4, 2009 teleconference that in the case where the class MC interval is different than the remainder of the IS1 program, the phrase refers to the class MC interval. The intervals for class MC components and the remainder of the IS1 program are treated separately. As such, in accordance with 10 CFR 50.55a(g)(4)(ii) and 10 CFR 50.55a(g)(6)(ii)(B), the 2003 Addenda is the appropriate addenda for the second interval of the CIS1 program at each site and adopting the 2003 Addenda for the second interval of the CIS1 program at each site does not require NRC approval.
