TRANSMITTAL OF CERTAIN REVISED FUEL CYCLE OVERSIGHT PROCESS DRAFT DOCUMENTS FOR REVIEW AND COMMENT

Dear Mr. Killar:

The purpose of this letter is to provide several key draft Revised Fuel Cycle Oversight Process (RFCOP) documents for review and comment to facilitate discussions at the upcoming public meeting. To aid in prioritizing review of these documents, we believe reviewing the documents in the order listed below may be beneficial:

Inspection Manual Chapter (IMC)-RFCOP - Fuel Cycle Oversight Process Basis Document IMC-RFCOP - Fuel Cycle Facility Assessment Program IMC-RFCOP - Fuel Cycle Significance Determination Process IMC-RFCOP - Fuel Cycle Facility Operational Safety and Safeguards Inspection Program IMC-RFCOP-SDP, Appendix B Emergency Preparedness SDP As was discussed during the last public meeting conducted at the U.S. Nuclear Regulatory Commissions (NRCs) Region II office on July 28 - 30, 2009, we have developed our overall project schedule to include a 30-day comment period which begins upon issuance date of this letter. In addition, there was agreement that the NRC would conduct a followup public meeting to discuss the comments at least two weeks after issuance of the documents allowing the industry sufficient time for review. The NRC is currently contemplating a meeting to hear stakeholder comments on these documents in late September or early October. Additional details on plans for the next public meeting will be subject of separate correspondence.

As you review the documents, please note that much of the content of the documents represents implementing level guidance for the NRC staff for the various elements of the revised process. Therefore, it may be very beneficial for the industry to focus its review on the information that would have a direct impact on the NRCs assessment of licensee performance. to this letter provides specific sections for each document that may be of more benefit to the industry and other stakeholders during their review.

In accordance with 10 CFR 2.790 of the NRCs Rules of Practice, a copy of this letter and its enclosure(s) will be available electronically for public inspection in the NRC Public Document Room or from the NRC document system (ADAMS).
