CLINTON POWER STATION, UNIT NO.1 - WITHDRAWAL OF LICENSE AMENDMENT REQUEST RE: AMENDMENT TO TECHNICAL SPECIFICATION SECTION 3.3.6.1, "PRIMARY CONTAINMENT AND DRYWELL ISOLATION INSTRUMENTATION," TO ELIMINATE REQUIREMENTS FOR MAIN STEAMLINE ISOLATION ON HIGH TURBINE BUILDING TEMPERATURE (TAC NO. ME1499)
Dear Mr. Pardee:
By letter to the Nuclear Regulatory Commission (NRC) dated June 15, 2009 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML091660580), Exelon Generation Company (EGC), LLC submitted a request for amendment to technical specification (TS) Section 3.3.6.1, "Primary Containment and Drywell Isolation Instrumentation," to eliminate requirements for main steamline isolation on high turbine building temperature for the Clinton Power Station, Unit NO.1. By letter dated June 20,2009 (ADAMS Accession No. ML091730148), EGC requested the NRC to process aforementioned amendment on an emergency basis per Title 10 of the Code of Federal Regulations (10 CFR) Part 50.91 (a)(5).
In reviewing the June 15, 2009, submittal, the NRC staff identified the need for additional information, and on June 22, 2009, a conference call was held between the NRC staff and EGC to discuss the requested information. Upon review of all the information provided by EGC, the NRC staff identified technical and regulatory issues during its review that precluded prompt determination that the proposed changes were acceptable. Therefore, by letter dated July 2, 2009 (ADAMS Accession No. ML091760618), the NRC staff determined the amendment would not be processed on an emergency basis in accordance with 10 CFR 50.91 (a)(5).

- 2 By letter to the NRC dated August 4, 2009 (ADAMS Accession No. IVIL092170159), EGC withdrew the request for amendment to TS Section 3.3.6.1 as noted above. The NRC staff hereby acknowledges your request for withdrawal of the license amendment request to TS Section 3.3.6.1.
The Commission has filed the enclosed Notice of Withdrawal of Application for Amendment to Facility Operating LIcense with the Office of the Federal Register for publication.

DOCKET NO. 50-461 NOTICE OF WITHDRAWAL OF APPLICATION FOR AMENDMENT TO FACILITY OPERATING LICENSE The U.S. Nuclear Regulatory Commission (the Commission) has granted the request of Exelon Generation Company, LLC (the licensee) to withdraw its June 15, 2009 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML091660580),
application for proposed amendment to Facility Operating License No. NPF-62 for the Clinton Power Station, Unit No.1, located in DeWitt County.
The proposed amendment would have eliminated the requirement for main steamline isolations on high turbine building temperatures from Technical Specifications Section 3.3.6.1, "Primary Containment and Drywellisolation Instrumentation," Table 3.3.6.1-1.
The Commission had previously issued a Notice of Consideration of Issuance of Amendment published in the FEDERAL REGISTER on July 16, 2009 (74 FR 34594-34596).
However, by letter dated August 4, 2009, the licensee withdrew the proposed change.

which withdrew the application for license amendment.
