Dear Chairman Jaczko:
Pending before the Commission is the threshold question of the Commissions statutory authority to reinstate TVAs previously-withdrawn construction permits, posed by the Commission in its Order of May 20, 2009. To ensure that the Commission is kept currently informed of information related to matters pending before it, we would like to notify you that, by letter from Ashok Bhatnagar to the NRC, dated August 10, 2009, Tennessee Valley Authority (TVA) requested that the NRC authorize transition of Bellefonte Nuclear Plant, Units 1 and 2 (BLN 1 & 2) to a deferred plant status, from their current terminated status. A copy of this letter is attached for your information.
This action is in keeping with the Order issued by the Director, Office of Nuclear Reactor Regulation (NRR) on March 9, 2009, reinstating the Construction Permits for BLN 1 & 2, Nos. CPPR-122 and CPPR-123, respectively. The Order provides that the Director may authorize the transition to a deferred status upon a determination that TVA has complied with the guidance and provisions under Section III.A, Deferred Plant, of the Commissions Policy Statement on Deferred Plants. 74 Fed.
