WOLF CREEK GENERATING STATION - CORRECTION TO AMENDMENT NO. 185, RE: ADOPTION OF TSTF-511, REVISION 0, "ELIMINATION OF WORKING HOUR RESTRICTIONS FROM TS 5.2.2 TO SUPPORT COMPLIANCE WITH 10 CFR PART 26" (TAC NO. ME0805)

Dear Mr. Muench:

On August 7, 2009, the U.S. Nuclear Regulatory Commission (NRC) issued Amendment No. 185 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML091730191) to Facility Operating License No. NPF-42 for the Wolf Creek Generating Station (WCGS). The amendment was in response to your application dated March 6, 2009, as supplemented by letter dated July 14, 2009. The amendment revised Technical Specification (TS) 5.2.2, "Unit Staff," to eliminate working hour restrictions in paragraph d to support compliance with Title 10 of the Code of Federal Regulations (10 CFR) Part 26.

Mr. Steve Wideman of your staff notified the NRC staff via phone call on August 11, 2009, of a discrepancy on page 2 of the amendment. Specifically, paragraph 3 of page 2 of the amendment currently reads:

The license amendment is effective as its date of issuance and shall be implemented within 30 days of the date of issuance.

However, in its submittal, Wolf Creek Nuclear Operating Corporation requested approval of the license amendment by August 3, 2009, in order to support implementation of the TS changes concurrent with implementation of the new 10 CFR Part 26, Subpart I requirements by October 1, 2009. Therefore, paragraph 3 of the amendment page 2 has been revised to read as follows:

The license amendment is effective as its date of issuance and shall be implemented by October 1,2009.

This administrative error affected only page 2 of the WCGS Amendment No. 185, dated August 7, 2009, and does not change the staffs conclusions regarding Amendment No. 185.

Enclosed is a corrected page 2 for Amendment No. 185; please replace it with page 2 of the amendment issued on August 7,2009.

Accordingly, the license is amended by changes to the Technical Specifications as indicated in the attachment to this license amendment and Paragraph 2.C.(2) of Renewed Facility Operating License No. NPF-42 is hereby amended to read as follows:

Technical Specifications and Environmental Protection Plan The Technical Specifications contained in Appendix A, as revised through Amendment No. 185, and the Environmental Protection Plan contained in Appendix B, both of which are attached hereto, are hereby incorporated in the license. The Corporation shall operate the facility in accordance with the Technical Specifications and the Environmental Protection Plan.

The license amendment is effective as of its date of issuance and shall be implemented by October 1, 2009.
