EMS Audit Decision for TXU Comanche Peak (RNI 03044053)

Dear Mr. Turner:

Thank you for your active participation in the Texas Commission on Environmental Quality (TCEQ)

Environmental Management System (EMS) audit and for your commitment to environmental perfonnance.

The TCEQ has reviewed the audit of the EMS used at the TXU Comanche Peak operations located at 6322 North FM 56, in Glen Rose.

The audit was performed November 9-11,2004 and AprilS, 2005. Consistent with the TCEQ EMS Audit Protocol, the TCEQ audited the system against the Minimum Standards for EMSs described in 30 Texas Administrative Code §90.32 and to the requirements in the Environmental Protection Agency's National Environmental Performance Track (EPA NEPT) as described in 30 TAC §90.38.

Since all three nonconformances found in the November audit have been addressed, the TCEQ approves the EMS as allowed by the established TCEQ Audit Protocol. The approval applies only to the operations at 6322 North FM 56 (RNI03044053), Glen Rose.

Your Clean Texas, Cleaner World membership at the National Leader level will be effective on April 26, 2005,and last for three years. At least one surveillance audit will need to occur approximately 18 months into the certification period. In this audit, conducted and reported according to the TCEQ Audit Protocol or the TCEQ Third-party Auditor Guidance, you must demonstrate progress toward environmental improvement goals.
