WASHINGTON STATE UNIVERSITY - INCORPORATON OF THE SAFEGUARDS CONTINGENCY PLAN INTO THE PHYSICAL SECURITY PLAN

Dear Dr. Wall:

This is in response to your letter dated May 26, 2009, in which Washington State University requested the U.S. Nuclear Regulatory Commission (NRC) to review and approve a proposed safeguards contingency plan for the Washington State University Nuclear Radiation Center Reactor (NRCR) based on the criteria in Appendix C of Title 10 of the Code of Federal Regulations (10 CFR) Part 73 required under the provisions of 10 CFR 73.60(e). Based on telephone conversations on June 25 and 29, 2009, we understand that you intend to incorporate your safeguards contingency plan into your physical security plan in accordance with the provisions of 10 CFR 50.54(p)(2). On July 1, 2009, you submitted a letter stating that you had made a determination that incorporating your safeguards contingency plan does not decrease the safeguard effectiveness of your security plan. You also indicated that you have implemented the safeguards contingency plan in accordance with 10 CFR 50.54(p)(2).

Based on the NRCs review of the Safeguards Contingency Plan for Washington State University Nuclear Radiation Center, we find that the contingency plan meets the criteria in 10 CFR Part 73 Appendix C, satisfies the requirements under the provisions of 10 CFR 73.60(e), and therefore, the NRC finds the contingency plan acceptable.

Based on your determination that the incorporation of the contingency plan into the security plan does not decrease the effectiveness of the security plan in accordance with 50.54(p), no commission approval is required. Implementation of this change will be subject to inspection to confirm that the change has not decreased the effectiveness of your security plan.
